Are your employment contracts up to date?

Having a written employment contract is an essential part of any employment relationship. The contract sets out clear expectations and obligations regarding the relationship that protects both the employee and employer from potential disputes, misunderstandings, or conflicts in the future.

A well-prepared employment contract will reflect the way in which your business operates, which may be different from what is required under legislation and the appropriate Modern Award, if applicable.

 

Common ways in which businesses move away from an Award include paying above-award wages or providing additional entitlements. These additional payments can come as a trade-off to other conditions e.g. expectation to work weekends, public holidays or more than 38 hours per week.

To ensure these changes are enforceable, it is important that the employment contract clearly states how a condition is ‘set off’.

 

A well-prepared contract also reflects current legislation as it affects the employment relationship. Amendments to industrial relations legislation and various court cases in recent  years have changed and redefined many employment relationships and employment conditions. It is important that employers are not caught out as fines and other penalties can apply where employers have knowingly or recklessly failed to correctly represent the relationship and employment conditions.
